Conditions of Hire

1. CONTRACT

1.1 The booking is a contract between Rosmar Ltd t/a Hire A Holiday ("the Company") and the Customer under which the Company hires and lets to the Customer the Vehicle described in the Schedule ("the Vehicle").

 

2. HIRE FEE

2.1 The particulars of the hire fee ("Hire Fee") for the Vehicle are as listed in the Schedule.

2.2 A 25% non-refundable deposit is payable upon confirmation of booking. The balance of the Hire Fee is payable 7 business days prior to the day on which the Vehicle hire commences.

2.3 If the Vehicle is returned past the date and specified time in the Schedule, the Company reserves the right to impose an overtime charge of $50.00 per hour.

2.4 If the Hirer is paying by either credit card (Visa or Mastercard) or PayPal a recovery fee of 4% of the full amount of the hire will be charged.

2.5 All hires shall be deemed to have commenced at 9:00am on the day which the Vehicle is to be picked up, as listed in the schedule regardless of the actual time of day at which the Vehicle is picked up. All bookings will be charged as if the Vehicle was hired out for a period including the day of return, regardless of whether the Vehicle is returned earlier than the day and time listed in the schedule.


3. RESTRICTION OF HIRE

3.1 Any driver of the Vehicle must be at least 25 years of age and hold a full drivers licence.  For drivers 75 years or over, a medical certificate stating that they are fit to drive for the duration of the hire is required upon Pick Up.  Proof of license must be presented at time of Vehicle Pick Up.

3.2 The Customer agrees not to part with the possession or control of the Vehicle and not to allow any person other than the agreed drivers to drive the Vehicle, unless otherwise authorised by the Company.

3.3 The Vehicle must be driven only on sealed/bitumen or well-maintained roads.

3.4 The Vehicle must not be driven on any roads as listed on www.hireaholiday.co.nz. This list is subject to change at any time and without notice being given to the customer.

3.5 Unlimited mileage is allowed.


4. INSURANCE

4.1 The Vehicle comes with comprehensive insurance cover. The insurance excess in the event of any damage to the Vehicle or third party damage is $5,000.00 and a bond of this amount is taken 7 days prior to Pick Up.  The insurance excess in the event of any damage to the Vehicle or third party damage can be reduced to $2,500.00 with a charge of $20.00 per day of hire.  If this option is chosen, the bond held will only be $2,500.00.  The Customer will also be fully liable for demurrage - the daily rental rate for the period the Vehicle is off fleet for accident repairs (max 7 days) - and for replacing or repairing damaged windscreens and tyres. Overhead and under-body damage on the rented Vehicle is not covered. The bond can be paid by cash or credit card.  The bond is fully refundable subject to the return of the Vehicle to the agreed location, on the agreed date, in clean condition and with no damage, with a full tank of fuel full bottle of gas (if applicable), the toilet cassette and waste water tank emptied and no equipment lost or damaged.

4.2 If the Customer does not choose to purchase an Excess Reduction option from the Company, a bond of $5,000.00 is taken. This bond is deducted from the Customer’s credit card when they pick up their Vehicle. When the Vehicle is returned to the Company undamaged, the excess is refunded. Like other currencies, the NZ Dollar does fluctuate, sometimes by up to 3 or 4 cents in a period of only 3-5 weeks. Fluctuating exchange rates, the difference between buy and sell rates charged by banks as well as bank fees, may result in the amount refunded being different. The Company is not liable for currency variations or bank transaction fees which may be payable, depending on the credit card provider.

4.3 The Customer agrees not to do any of the following:

4.2.1 Allow the Vehicle to be driven by a person who is under the influence of any intoxicating substance or drug; or

4.2.2 Allow the Vehicle to be driven by a person who has a proportion of alcohol in the breath/blood which exceeds the legal limit; or

4.2.3 Allow the Vehicle to be driven by a person who fails to supply a blood or breath sample as required by law; or

4.2.4 Allow the Vehicle to be driven by a person who fails to stop, or remain at the scene, following an accident as required by law; or

4.2.5 The Company shall not be liable for loss to or damage resulting to personal items and belongings and personal injury in the event of an accident.


5. CHILDREN

5.1 The Company will endeavour to assist in the provision of child and/or booster seats, however ultimate responsibility lies with the Customer to ensure compliance with all laws and regulations in relation to this matter. 6. TRAFFIC INFRINGEMENTS

6.1 The Customer is liable for all fines and penalties in relation to the driver's use of the Vehicle or the Vehicle itself  incurred during the rental period plus an administration fee of $25.00 for each infringement or penalty notice that has been redirected by the Company to the Customer.


7. TOILET/SMOKING/PETS

7.1 The Customer is responsible for emptying the toilet and waste tanks prior to returning the Vehicle to Company.  Failure to do so will incur a charge of $100.00.

7.2 The Vehicle will be subject to a strict no smoking policy, unless otherwise authorised by the Company. Offenders will be charged a fume removal fee of $500.00.

7.3 Pets are not permitted in any Vehicle. Offenders will be charged a fume removal fee of $NZ 500.


8. BREAKDOWN/ACCIDENTS/INCIDENTS

8.1 Every effort will be made by the Company to ensure the Vehicle is in a safe and road worthy condition prior to each and every hire.  The Company shall ensure that a valid Warrant of Fitness/Certificate of Fitness, Electrical Warrant of Fitness, self containment Certificate and registration is in place for the intended term of the proposed hire, plus a further five days.  Unlimited Road User Charges will also be payable by the Company, and any associated costs thereof.

8.2 The Company shall not be under liability for any third party claims or damages in connection with or in consequence of, any accident or breakdown.

8.3 The Vehicles will have breakdown insurance.  In the event of a breakdown, the user of the Vehicle shall have access to roadside assistance services.

8.4 The Customer must obtain consent from the Company in respect of repairs and parts replacements which are to a value greater than $200.00.  Any essential repairs below $200.00 shall be paid by the Company to the Customer, where such repairs and replacements are necessary through general use of the Vehicle as opposed to those which are required due to any fault on the part of the Customer.  Receipts must be submitted for any repair or the claim will not be paid.

8.5 Any overhead damage is the responsibility of the Customer, without limitation as to amount.  The height of the Vehicle is noted in the Schedule.

8.6 Tyre damage including punctures, and damage to the windscreen and windows are the Customer's responsibility.

8.7 Any call out charges due to negligence on the part of the Customer or any third party using the Vehicle; for example, flat tyres, wrong fuel, lost keys, etc, shall not be the Company's responsibility.


9. FUEL/GAS/OIL

9.1 A full tank of fuel will be provided with the Vehicle at the start of hire and the Customer is expected to return the Vehicle to the Company with a full tank of fuel.

9.2 The Customer shall be charged $2.50 per litre if the Vehicle is brought back with less fuel.

9.3 It is the Customer's responsibility to ensure that oil and water levels and tyres are checked on a daily basis.

9.4 A full gas cylinder will be supplied where the Vehicle has gas facilities. It is the Customers responsibility to ensure the gas cylinder is full upon return.  A fee of $50.00 will be payable where the gas bottle is not full upon return.

 

10. PICK UP/DROP OFF

10.1 Collection time for the Vehicle is to be agreed with the Company in advance.

10.2 The Company and the Customer shall allow at least half an hour prior to pick up time for the explanation of how features of the Vehicle work, by a person suitably knowledgeable to make such explanation, unless otherwise agreed between the parties.  A further half an hour must be allowed at the end of the hire to confirm the Vehicle and all other administration matters are in order.


11. INDEMNITY

11.1 The Customer will at all times indemnify the Company in respect of any loss or damage, special or consequential, and whether arising in tort (including negligence or breach of statutory duty), contract or otherwise, which may be suffered by the Company as a direct or indirect result of any breach by the Customer of any of its obligations or warranties under this contract, or as a result of any negligence or other act or omission on the Customer's part.


12. CHANGE OF VEHICLE

12.1 If, for reasons beyond the Company's control, a reserve Vehicle is not available, we reserve the right to substitute a comparable or superior Vehicle at no extra cost to the customer. This shall not constitute a breach of contract and does not entitle the renter to any form of refund.


13. LIMITATION OF LIABILITY

13.1 If, for reasons beyond our control, no Vehicle is available to the hirer, the Company's liability is limited to a refund of the hire fee in full. In the case of mechanical failure (unless caused by the hirer), the Company's liability will be limited to the Hire Fee for the remainder of the hire period.


14. ONE WAY HIRES

14.1 A fee equivalent to that listed in the schedule will be payable where the Vehicle is to be dropped off at a location other than where it is picked up.


15. GENERAL

15.1 The terms and conditions contained herein are subject to change as required without prior notification.

15.2 All amounts listed in this document are in New Zealand Dollars and are exclusive of GST, where GST is applicable.

15.3 All bookings are strictly subject to availability and the Company reserves the right to replace the Vehicle with another similar Vehicle.

15.4 All hires shall be deemed to have commenced at 9:00am on the day which the Vehicle is to be picked up, as listed in the schedule regardless of the actual time of day at which the Vehicle is picked up.

15.5 All bookings will be charged as if the Vehicle was hired out for a period including the day of return, regardless of whether the Vehicle is returned earlier than the day and time listed in the schedule, but subject to the penalty provision in clause 2.3.

15.6 A first aid kit is provided in each Vehicle. If the seal is broken or the kit is not returned a fee of $25.00 will be charged.
